Office of the District Attorney P. David Soares DWI Charge Nets 1 1/3 – 4 in State Prison ALBANY, NY – Albany County District Attorney P. David Soares announced today that EDWARD RUIZ, 43, of 1168 Western Avenue, Albany, NY, was sentenced to 1 1/3 to 4 years in State Prison with a $2000 fine by the Honorable Thomas A. Breslin. RUIZ pled guilty to a felony charge of Operating a Vehicle While Under the Influence of Alcohol on June 16 th, 2005. RUIZ was arrested by Officers from the Albany County Sheriff’s Department on State Route 85 in the Town of New Scotland on April 5 th 2005 after a traffic stop for speeding, failing to keep right and failing to dim his lights. RUIZ was given field sobriety tests and after failing all of them he was given a breathalyzer test in which he blew a 0.14%, well over the legal limit of 0.8%. RUIZ’ sentence to State Prison reflects both his long time inability to control his desire to use the public roadways after consuming alcohol, and the DA’s emphasis on the criminality of drunk driving. “This is RUIZ’s 6 th conviction for driving under the influence of alcohol”, DA Soares said. “Drunk driving is a dangerous and violent crime and it is simply irresponsible to continue to allow these repeat offenders access to the public roadways”, he said.
