Brooklyn Man Sentenced to 6 Years For Gun Possession

ALBANY , NY – District Attorney P. David Soares today announced that DWAYNE HIGGINS, 30, of Brooklyn, NY, was sentenced to six years in prison and three years post release supervision by the Honorable Stephen W. Herrick. On February 21, 2008, HIGGINS pled guilty to Attempted Criminal Possession of a Weapon in the Second Degree.

“The number of illegal weapons on our streets has contributed to an arms race in our neighborhoods that will not be tolerated by this office, and can not be tolerated by our community. I will continue to use the law to put these criminals in prison, but I need the help of all citizens to identify these dangerous individuals who make our streets unsafe for our children and families,” commented DA Soares.

On June 20, 2007, at 8:20 P.M. on I-787 Northbound Exit 1, HIGGINS was pulled over for a vehicle and traffic infraction. Upon interviewing the occupants, the Officers observed four marihuana stems in the cup holder and smelled an odor of marihuana coming from the interior of the vehicle. Upon removing the occupants, the Officers recovered a loaded 9 millimeter Kel-Tec firearm and a loaded .38 caliber Colt revolver under the center console. Additionally, the Officers recovered about a pound of marihuana from the interior of the vehicle.

Street Crimes Bureau Chief Francisco Calderon handled the prosecution of this case.
