Boothby Takes Plea in Racially Motivated Crime

ALBANY , NY –  District Attorney P. David Soares today announced that JASON BOOTHBY, 29, of 953 New Scotland Avenue, Albany, NY plead guilty  to (1) count of Attempted Criminal Possession of a Weapon in the 3rd Degree and (1) count of Menacing in the 2nd Degree in front of the Honorable Thomas Breslin. In the terms of the plea, BOOTHBY faces a sentence of 1½ to 3 years for the first count to serve concurrently with a 1-year sentence for the second count.

The indictment alleges that on January 28, 2007 at approximately 5:52 p.m. at the corner of South Pearl Street and Market Street in Albany, BOOTHBY approached a father and two young sons after calling them a racial epithet, put a knife to the chest of one of the boys and stated, “I am going to stick that ‘racial epithet.’”

“Criminals who intentionally target victims solely on the basis of their race will face harsh prosecution by this office,” stated DA Soares. “Hate crimes are unacceptable at any time and under any circumstance, and will not be tolerated in Albany County.”

BOOTHBY will be sentenced on June 15, 2007.
