Recent Arraignments in 


Several Vehicular Crimes Cases



ALBANY, NY - District Attorney P. David Soares announced today that several vehicular crime arraignments took place this week in Albany County Court as Grand Jury presentations have resumed. Among the cases, of note are:


JAMES FISH, 52, of Albany, was arraigned on (2) Counts of Driving While Intoxicated, both Class D Felonies, and (1) Count of Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree, a Class E Felony, before the Honorable Andra Ackerman in Albany County Court this morning.


A Grand Jury returned an indictment alleging that on December 7, 2020, while on Farnsworth Drive in the Town of Guilderland, FISH was operating a motor vehicle while intoxicated. Police were called to the area for reports of a disturbance and upon arrival they found FISH behind the wheel with a strong odor of alcoholic beverages coming from the car. FISH failed multiple standardized field sobriety tests and was placed under arrest. Subsequently, FISH registered a BAC of .18 on a Datamaster Breath Analysis test. It was determined that FISH’s driver’s license was suspended from a prior DWI conviction. At the time of the arrest it was determined that FISH has five prior alcohol related driving offenses.

FISH pleaded not guilty to the charges today and was released under the supervision of the Department of Probation. Assistant District Attorney Collin D’Arcy of the Vehicular Crimes Unit is handling the prosecution of this case.


In an unrelated case, NYREE SHELDON, 27, of Albany, was arraigned on (1) Count of Aggravated Driving While Intoxicated with a Child in the Vehicle, a Class E Felony, and (1) Count of Endangering the Welfare of a Child, a Class A Misdemeanor, before the Honorable William A. Carter in Albany County Court on March 24, 2021.


On July 13, 2020, at approximately 12:38 A.M., while on I-787 in the Village of Menands, police conducted a traffic stop on SHELDON’s vehicle after observing traffic infractions. Upon approach of the vehicle officers could see heavy wafts of smoke coming from both the driver’s side and passenger side windows. Police recovered a burned marijuana cigarette from the vehicle and observed a ten month old child in a rear car seat. It was determined that SHELDON was operating a motor vehicle while impaired by marijuana.


SHELDON pleaded not guilty to the charges today and was released under the supervision of the Department of Probation.


In addition, JACKLYNN DICKERT, 41, of East Greenbush, was arraigned on (1) Count of Aggravated Driving While Intoxicated with a Child in the Vehicle, a Class E Felony, (1) Count of Driving While Intoxicated, a Class E Felony, (1) Count of Endangering the Welfare of a Child, a Class A Misdemeanor, and (1) Count of Refusal to Take a Breath Test, a Traffic Infraction, before the Honorable William A. Carter in Albany County Court this morning.


On June 4, 2020, approximately 5:54 P.M., the Colonie Police were called to investigate an incident in the Colonie Center parking lot after a third party suspected DICKERT of driving while intoxicated while a 7 year old child was in the vehicle. DICKERT appeared to have bloodshot eyes and was emitting an odor of alcoholic beverages, in addition to having stains on her clothing that appeared to be wine. DICKERT refused all sobriety testing and chemical screening.


DICKERT pleaded not guilty to the charges today and was released under the supervision of the Department of Probation.

Vehicular Crimes Bureau Chief Mary Tanner-Richter is handling the prosecution of SHELDON and DICKERT.
