ALBANY, NY -  District Attorney P. David Soares announced today that JOSEPH EVANS, 20, and an 18-year-old who will not be named due to his age at the time of the alleged incident, both from Cohoes, were arraigned before the Honorable William A. Carter in Albany County Court this afternoon for their respective roles in a fatal shooting incident in Cohoes on June 30, 2020.

The indictment that was unsealed in Court today alleges that on or about June 30, 2020, in the area of 27 Lansing Street in the City of Cohoes, the charged parties were in illegal possession of a loaded firearm. They were each charged with (1) Count of Criminal Possession of a Weapon in the Second Degree, as Class C Armed Violent Felonies.

On that date of the incident, around 2:15 P.M., members of the Cohoes Police responded to the area of Lansing and Schuyler Streets for a report of a male who had been shot. Upon arrival they found 18-year-old Tyshawn Daniels lying on the ground with apparent gunshot wounds. The victim was transported to a local hospital where he later succumbed to his injuries.

An investigation uncovered the involvement of the charged parties, and the Grand Jury returned the illegal weapons possession charges in relation to the incident.

Both charged parties pleaded not guilty to the crimes alleged today. Bail was set in the amount of $25,000 cash or $35,000 bond for EVANS, who currently remains in custody.

The 18-year-old charged party was released under the supervision of probation, with a condition of electronic monitoring. A return appearance for the 18-year-old has been scheduled under the mandatory 6-day review process for alleged adolescent offenders.

No other appearance dates have been scheduled by the Court at this time.

Assistant District Attorney David Szalda is handling the prosecution of this case.
