 Guilty Plea in February Fatal Shooting Case



  

 

ALBANY, NY -  District Attorney P. David Soares announced today that DARRYL SMITH, 34, of Albany, pleaded guilty to (1) Count of Criminal Possession of a Weapon in the Second Degree, a Class C Armed Felony, before the Honorable Andra Ackerman in Albany County Court this morning for his role in a fatal shooting in the City of Albany on February 8, 2020. 

On February 8, 2020, at approximately 9:50 P.M., SMITH fired an illegally possessed firearm at a residence on Clinton Avenue in the City of Albany, ultimately striking a male victim that was inside of the residence. SMITH was observed by on-duty officers while he was standing in the street firing at the residence. Upon seeing the officers, SMITH dropped the gun and surrendered.

Further investigation revealed that an argument had ensued between parties and the first shots were fired from inside of the home towards parties out on the street. One of the residents in the home was determined to be 19-year-old Irving Lamboy of Albany who ultimately sustained a gunshot wound to the back. Mr. Lamboy was treated at the scene by medical personnel and transported to a hospital where he was later pronounced deceased.

SMITH faces up to (9) years in State Prison, to be followed by (5) years of Post-Release Supervision, when sentenced on November 16, 2020.

Assistant District Attorney Collin D'Arcy and Assistant District Attorney Michael Wetmore are handling the prosecution of this case.
