 Sentencing in Fentanyl Overdose Fatality Case


 

  


ALBANY, NY -  District Attorney P. David Soares announced today that NICHOLAS UZZO 31, of Troy, was sentenced to (3) years in State Prison before Honorable Peter A. Lynch in Albany County Supreme Court this morning.

UZZO previously pleaded guilty to (1) Count of Criminally Negligent Homicide, a Class E Felony, and (1) Count of Criminal Sale of a Controlled Substance in the Third Degree, a Class B Felony.

At the time of the guilty plea, UZZO admitted that on or about April 14, 2019, he sold a controlled substance to two individuals who believed that they were purchasing cocaine. The substance was actually fentanyl. As a result of UZZO’s criminal negligence, one of the victims died as a result of toxic consumption of the narcotics. The second individual also suffered an overdose but was revived by first responders and hospital staff.

Assistant District Attorney Alexander Scher of the Street Crimes Unit prosecuted this case.
