 Sentencing in Guilderland DWI Case


ALBANY, NY -District Attorney P. David Soares announced today that ARTHUR NEBE, 53, of East Greenbush, was sentenced to 1 and 1/3 to 4 years in State Prison before the Honorable Peter A. Lynch in Albany County Court this morning. In addition, NEBE is subject to court mandated fees, a minimum 18-month driver’s license revocation, subject to Department of Motor Vehicles guidelines, as well as a 3-year conditional discharge that he install an ignition interlock upon his release from custody. This is NEBE’s third driving while intoxicated related conviction.

On October 26, 2018, NEBE was pulled over for driving 94 miles per hour in an area designated as a 65 miles per hour zone on I-87 in the Town of Guilderland. At the time of the stop, NEBE displayed physical signs of intoxication and had open containers of alcohol in his vehicle. NEBE failed standardized field sobriety tests and had a blood alcohol content of .24 per cent approximately one hour after the traffic stop.

NEBE previously pleaded guilty to (1) Count of Aggravated Driving While Intoxicated, Per Se, (1) Count of Driving While Intoxicated, both as Class D felonies, and (1) Count of Drinking Alcohol in a Motor Vehicle on a Highway, a Traffic Infraction.

Vehicular Crimes Unit Bureau Chief Mary Tanner-Richter prosecuted this case.
