  50 Year Sentence in Cohoes Rape Case 

                           



ALBANY, NY – District Attorney P. David Soares today announced that DERRICK ROSA, 39, of Cohoes, NY, was sentenced to 25 years in State Prison for (1) Count of Criminal Sexual Act in the First Degree and a consecutive sentence of 25 years in State Prison for (1) Count of Rape in the First Degree, for a total of 50 years in State Prison, to be followed by 25 years of Post- Release Supervision, before the Honorable William A. Carter in Albany County Court this morning.

Additionally, ROSA will have to register as a sex offender upon release.

On January 11, 2019, ROSA was found guilty after a jury trial of (1) Count of Criminal Sexual Act in the First Degree, a Class B Felony, (1) Count of Criminal Sexual Act in the Second Degree, a Class D Felony, (2) Counts of Rape in the First Degree, each Class B Felonies, (1) Count of Rape in the Second Degree, a Class D Felony, (1) Count of Rape in the Third Degree, a Class E Felony, and (2) Counts of Endangering the Welfare of a Child, each Class A Misdemeanors.

After deliberation and review of the presented evidence during the trial, the jury found that on an evening between October 9, 2014 and October 31, 2014, ROSA engaged in forcible oral sexual conduct with a child who was 14 years old at the time. Between November 27, 2014 and December 25, 2014, he engaged in forcible sexual intercourse with the same child. This conduct continued with the child until the final act of sexual intercourse occurred on August 22, 2017, again by forcible compulsion, when she was now 16 years old. Over the aforementioned period of time, ROSA engaged in multiple acts of physical abuse against the child as well. In addition, ROSA did knowingly act in a manner likely to be harmful to the physical, mental, or moral welfare of an additional child in the home during the same time period.
