Indictment in Bus Assault Case 

 

 

 

 

ALBANY, NY – District Attorney P. David Soares announced today that three defendants were indicted by an Albany County Grand Jury on charges related to an alleged incident that occurred on a CDTA bus on January 30, 2016.

ARIEL AGUDIO, 20, of Huntington, NY, was indicted on (1) Count of Assault in the Third Degree, a Class A Misdemeanor, (3) Counts of Attempted Assault in the Third Degree, all Class B Misdemeanors, (3) Counts of Falsely Reporting an Incident in the Third Degree, all Class A Misdemeanors, and (3) Counts of Harassment in the Second Degree, all Violations.


ASHA BURWELL, 20, of Huntington Station, NY, was indicted on (1) Count of Assault in the Third Degree, a Class A Misdemeanor, (4) Counts of Falsely Reporting an Incident in the Third Degree, all Class A Misdemeanors, and (1) Count of Harassment in the Second Degree, a Violation.

ALEXIS BRIGGS, 20, of Elmira Heights, NY, was indicted on (1) Count of Assault in the Third Degree, a Class A Misdemeanor, and (2) Counts of Falsely Reporting an Incident in the Third Degree, each Class A Misdemeanors.

The indictment alleges that around 1:00 a.m. on January 30, 2016, while aboard a CTDA bus on the UAlbany campus in the City of Albany, AGUDIO, BURWELL, and BRIGGS did allegedly cause physical injury to a 19 year old female passenger by means of repeatedly striking her.
 
In addition, the indictment also alleges that AGUDIO attempted to cause physical injury to a 19 year old male passenger by means of striking him repeatedly.  It is also alleged that AGUDIO attempted to assault and had physical contact with two other female bus passengers, ages 18 and 20.

BURWELL is also charged with allegedly having physical contact with a 19 year old male bus passenger.

In addition, the indictment also alleges that AGUDIO, BURWELL, and BRIGGS did falsely report the incident to law enforcement after exiting the bus on January 30th and in days following the alleged incident.

AGUDIO, BURWELL, and BRIGGS will appear to be arraigned on Wednesday May 4, 2016, in Albany County Court before Honorable Judge Stephen W. Herrick.
