| ALBANY, NY – District Attorney P. David Soares today announced that WALTER CLEVELAND, 20, of Albany, was indicted by a Grand Jury for the sexual assault of a child. CLEVELAND was indicted on (4) Counts of Predatory Sexual Assault Against a Child, all Class A-II Felonies, (4) Counts of Criminal Sexual Act in the First Degree, all Class B Felonies, (2) Counts of Attempted Criminal Sexual Act in the First Degree, both Class C Felonies, and (1) Count of Endangering the Welfare of a Child, a Class A Misdemeanor.
The indictment alleges that in the evening of August 14, 2012, in the vicinity of Lincoln Park in the City of Albany, CLEVELAND did intentionally commit the crime of predatory sexual assault and commit criminal sexual acts against a child less than 11 years old by the use of forcible compulsion. Two civilian witnesses observed the incident and called 911.
CLEVELAND is scheduled to be arraigned before Hon. Judge Lamont in Albany County Court on Wednesday August 22, 2012. CLEVELAND is currently in custody.
Assistant District Attorney Brett Knowles of the Special Victims Unit is handling the prosecution of this case.
