Office of the District Attorney P. David Soares Albany Man Pleads Guilty to Gun Crime, Faces 7 Years ALBANY , NY – Albany County District Attorney P. David Soares announced today that JOHN DAVIS, 31, of 536 Hamilton Street, Albany, NY, pled guilty to (1) count of Criminal Possession of a Weapon in the Second Degree, a Class “C” Armed Felony in front of the Honorable Stephen W. Herrick. In accordance with the plea, DAVIS faces seven years in prison and five years post release supervision. On July 29, 2007 at 4:19 A.M. at 529 Hamilton Street, the Albany Police Department responded to a call for shots fired. Police officers interviewed a witness that indicated DAVIS struck an individual with a gun and in the process the gun went off. After interviewing DAVIS, he told police where the gun was located and they recovered a .9-millimeter semiautomatic handgun. Sentencing for DAVIS is scheduled for November 26, 2007.
