Albany Man Found Guilty of Attempted Murder,
Faces 32 Years in Prison

ALBANY , NY –  District Attorney P. David Soares today announced that MICHAEL KINDRED, 23, of Albany, NY, was found guilty of (1) Count of Attempted Murder in the 2 nd Degree, (1) count of Assault in the 2 nd Degree, (1) count of Reckless Endangerment in the 1 st Degree and (1) count of Criminal Possession of a Weapon in the 2 nd Degree after a trial presided over by the Honorable Thomas Breslin. KINDRED faces a term in State Prison of up to 32 years.

“Albany now has one less dangerous criminal with a gun on our streets,” stated DA Soares. “This defendant was intent on hurting someone and it didn't matter who crossed his path. What is even more troubling is that he had access to an illegal gun. We have a gun problem in this city and I for one am tired of it. There is a dangerous, illegal urban arms race and hopefully these long sentences will be an incentive to disarm.”

On October 18, 2006 , at about 7:35 P.M. , on Third Street in Albany , MICHAEL KINDRED apparently took offense at the laughter of two men who were walking together down the street, carrying a pizza, talking and laughing with each other. KINDRED confronted them and they said they did not want a problem. KINDRED then pulled out a handgun and began shooting at them as they fled. One victim was hit in the back of his left thigh while the other victim testified that he felt a bullet buzz past his head, actually burning his hair. Both victims indicated that they could see sparks around them as bullets ricocheted. KINDRED fired 4-6 shots and then fled.

Just prior to the shooting, KINDRED had been identified by police on the basis of a “man with a weapon” call (a knife) while he was acting out at the corner of Third and Ontario . After parole officers came to the scene, KINDRED was released. Then, the defendant proceeded down Third Street in an agitated state reportedly stating that he planned to get a gun and “air the place out,” or words to that effect. The victims saw the defendant but paid him no mind. They then went to get pizza and encountered the defendant a short while later on their way home.

Prior to trial, KINDRED attempted to intimidate a victim by calling his home and threatening him nine times. Despite the threats, this courageous young man did testify at the trial, which lead to the conviction of KINDRED.

ADA Bruce Lennard from the Major Offense Unit handled the prosecution of this case.

Sentencing is scheduled for July 19, 2007 .
