Office of the District Attorney P. David Soares Albany Man Pleads Guilty to Assaulting Woman ALBANY , NY – District Attorney P. David Soares today announced that JOHN MARTZ, 31, of Scotia, NY, pled guilty to (1) count of Assault in the Second Degree, a Class “D” Felony in front of the Honorable Stephen Herrick. On May 1, 2008 on Fuller Road in the Town of Colonie, MARTZ kicked a female victim in the face while wearing boots causing facial fractures, bruising, swelling and substantial pain. Under the terms of the plea bargain, MARTZ faces up to 7 years in prison when sentenced on April 22, 2009.
