Schenectady Man Pleads Guilty to DWI, Crashing into Colonie Police Van

ALBANY , NY – District Attorney P. David Soares today announced that EARL BRANTLEY, 31, of Schenectady, NY, pled guilty to (1) count of Vehicular Assault in the Second Degree, a Class “E” Felony and (1) count of Driving While Intoxicated, a Class “A” Misdemeanor in front of the Honorable Thomas Breslin.

On January 3, 2009, BRANTLEY crashed his vehicle into the back of a Colonie Police Department van while an officer was sitting in the front seat. The van was on a traffic stop with another marked Colonie Police Car and both vehicles had their emergency lights activated. BRANTLEY’s car shoved the van into the back of the police car, seriously injuring the officer in the van. BRANTLEY showed signs of intoxication and was later found to have a BAC of .09 nearly four and a half hours after the crash.

Under the terms of the plea bargain, BRANTLEY faces 1 ½-3 years in state prison, when sentenced on May 19, 2009. BRANTLEY must also pay restitution for fees incurred as a result of the accident, pay fines and will have his license revoked.
