Office of the District Attorney P. David Soares NYS Legislative Assistant Charged Pleads Guilty to Stealing Insurance Benefits ALBANY , NY – District Attorney P. David Soares today announced that DIANE GAMBLE, 61, of Watervliet, NY, pled guilty to (1) count of Grand Larceny in the Third Degree, a Class “D” Felony. In accordance with the plea bargain, GAMBLE faces 1 2/3 to 5 years in prison when sentenced on May 8. 2009. Between August 1, 2004 and March 31, 2008, in the City of Albany, DIANE GAMBLE committed welfare fraud by fabricating weekly income amounts on Department of Social Services benefit applications. As a result, GAMBLE received $52,954.24 to which she was not entitled. GAMBLE worked for the New York State Assembly where she forged letters stating that she made much less than her actual salary of $ 79,090.07, according to the New York State Public Payroll. GAMBLE used the welfare funds to pay a home health aid that routinely ran errands for her. One of the aids she hired was former NBA player Michael Ray Richardson.
