David Soares announced today that PETER CAPONE, 40, of Cohoes, NY pled guilty to (1) count of Assault in the First Degree, a Class “B” Violent Felony, before the Honorable Stephen Herrick. Under the terms of the plea bargain, CAPONE will receive 20 years in prison and 5 years post release supervision when sentenced on May 16, 2008. On or about July 25, 2007, CAPONE did repeatedly strike the victim about the head and body with an unknown hard object causing serious physical injury to the victim consisting of a fractured skull, fractures to her arms, as well as other bruising and damage. DA Soares noted that, “The egregious actions taken by this criminal along with his complete lack of remorse make this case one of the most severe and disturbing cases of domestic violence this office has seen in a very long time. We will continue to make the prosecution of DV crimes a priority in this office and I am very pleased that this man will spend the next two decades of his life behind bars.” Special Victims and Homicide Bureau Chief Dave Rossi handled the prosecution of the case.
