Office of the District Attorney P. David Soares Boothby Sentenced for Racially Motivated Crime ALBANY , NY – District Attorney P. David Soares today announced that JASON BOOTHBY, 29, of 953 New Scotland Avenue, Albany, NY was sentenced to 1½ to 3 years for Attempted Criminal Possession of a Weapon in the 3rd Degree to serve concurrently with a 1-year sentence for Menacing in the 2nd Degree in front of the Honorable Thomas Breslin. BOOTHBY plead guilty to both charges on April 13, 2007. On January 28, 2007 at approximately 5:52 p.m. at the corner of South Pearl Street and Market Street in Albany, BOOTHBY approached a father and two young sons after calling them a racial epithet, put a knife to the chest of one of the boys, and stated, “I am going to stick that ‘racial epithet.’” “There is no condition under which a hate crime is acceptable,” stated DA Soares. “If a member of our community is victimized solely for racially motivated reasons, there will be serious consequences to face.” Chief ADA Mark Harris handled the prosecution of this case.### For further information contact: Heather Streeter Orth
