Office of the District Attorney P. David Soares Nadeem Mall Pleads Guilty to Criminally Negligent Homicide ALBANY , NY – Albany County District Attorney P. David Soares announced today that NADEEM MALL, 32, of Schenectady, NY, pled guilty to (1) count of Criminally Negligent Homicide, a Class “E” Felony, in front of the Honorable Dan Lamont. According to the plea agreement, MALL will cooperate fully in the case against Edwin Tirado. Any violation of the plea agreement can result in a sentence of up to 4 years in prison. On February 15 th, 2007 beginning at 7:00 P.M. near 98 Wolf Road in the Town of Colonie and through the City of Schenectady and ending at the Oswald D. Heck Developmental Center at 500 Balltown Road at approximately 9:00 P.M., MALL did, with criminal negligence, cause the death of Jonathan Carey by continuing to drive a van while Edwin Tirado, Jr. inappropriately restrained the victim and compressed the victim’s body with his own body, causing the victim to stop breathing, and, having a legal duty to do so, failing to render aid or to provide, secure, or summon medical attention. “This plea was negotiated and agreed to only after extensive input and approval from the Carey Family,” commented DA Soares. “There is no punishment sufficient enough to compensate for the unnecessary death of a wonderful and vibrant young man.
