Teen Sentenced to 6 Years for Gun Possession

District Attorney P. David Soares today announced the sentencing of IQUAN CARTER, 17, of 18 McCardle Ave, Albany, NY, to (1) count of Criminal Possession of a Weapon in the 3 rd Degree, in front of the Honorable Daniel Lamont. CARTER was sentenced to 6 years in prison with 3 years post release supervision.

CARTER was convicted May 24 th after a trial by jury of possessing a loaded firearm on August 29, 2006 . On that day, at 10:10 AM , CARTER and two co-defendants, AHMAD FLEMING and Jauwan Giles, were pulled over for not driving with headlights while it was raining. During the stop, the officer smelled marihuana and observed the back seat passenger jumping around. The officer had the back seat passenger get out of the vehicle and saw small amounts of marihuana in the car. After attempting to retrieve the marihuana from the ash tray, the officer saw a .380 caliber firearm that was loaded with 7 live rounds in between the passenger seat and center console. FLEMING pled guilty to the same charge and faces 5 years in prison. Sentencing will be held on September 26 th. Giles was acquitted after a trial by jury, which believed he was unaware of the weapon in the car.

“This is another case in which ‘Operation Speeding Bullet’ has quickly taken another gun and criminal off our streets,” commented DA Soares. “In this instance, a young man will be going to prison for the next six years rather than enjoying those years with his friends and family. This should be a reminder to everyone in our community that you don’t even need to display or use a gun to face severe prosecution, you can and will receive significant prison time for just possessing an illegal weapon in this county.”

Street Crimes Bureau Chief Francisco Calderon handled the prosecution of the case.
