Jermayne Timmons Found Guilty of Murdering Kathina Thomas

ALBANY, NY – District Attorney P. David Soares today announced that JERMAYNE TIMMONS, A.K.A. “MAINE”, 16, of Albany, NY, was found guilty of (1) count of Murder in the Second Degree, a Class “A-1” Felony and (1) count of Criminal Possession of a Weapon in the Second Degree, a Class “C” Violent Felony, in front of the Honorable Stephen Herrick. TIMMONS was remanded into the custody of the Albany County Sheriff and faces 15 years to life in prison when sentenced March 5, 2009.

“I would like to thank the jury for their service to the people of Albany County and the Albany Police Department for their diligent work in investigating this case,” commented DA Soares. “That one bullet fired on the evening of May 29 th has tragically altered the lives of two young people and their families. One family has just buried their child while the other family is losing their child to the criminal justice system. This community must come together and say enough is enough, or this will not be the last tragedy we see on the streets of Albany,” commented DA Soares.

On May 29, 2008 at approximately 8:15 P.M. in the area of First Street in the City of Albany, JERMAYNE TIMMONS fired a loaded handgun with depraved indifference at individuals running away from him. The bullet missed those individuals and hit 10-year-old Kathina Thomas who later died from her injuries.

Homicide and Special Victims Bureau Chief Dave Rossi is handling the prosecution of this case.
