Two Watervliet Men Indicted for Tampering With a Witness ALBANY, NY – District Attorney P. David Soares today announced that SHAWN ROBERTS, 28, of Watervliet, NY was indicted on (7) counts including: (3) counts of Criminal Sale of a Controlled Substance in the Third Degree, a Class “B” Felony, (2) counts of Robbery in the Second Degree, a Class “C” Violent Felony, (1) count of Assault in the Second Degree, a Class “D” Violent Felony and (1) count of Tampering with a Witness in the Third Degree, a Class “E” Felony. ROBERTS faces up to 60 years in prison. IAN GREENE, 22, of Watervliet, NY, was indicted by the Grand Jury on five counts including: (2) counts of Robbery in the Second Degree, a Class “C” Violent Felony, (1) count of Assault in the Second Degree, a Class “D” Violent Felony, (1) count of Tampering with a Witness in the Third Degree, a Class “E” Felony and (1) count of Criminal Possession of a Weapon in the Third Degree, a Class “D” Armed, Violent Felony. GREENE faces up to 15 years in prison. “The protection of witnesses is the single most important issue for prosecutors,” commented DA Soares. “The successful prosecution of criminals hinges on the ability of witnesses to come forward, be truthful and be comfortable in the court of law doing so. The intimidation of witnesses will not be tolerated by this office and these two men will be prosecuted to the fullest extent of the law.” The indictment alleges that on January 24, 2008, at approximately 11:06 P.M. at 19 Idlewild Park in the Town of Colonie, ROBERTS and GREENE, knowing the victim could be called as a witness to testify in a criminal proceeding, did attempt to compel the victim to absent himself or otherwise avoid testifying in such proceeding by means of instilling fear in said victim by stealing his property by using physical force consisting of burning his ear with a heated grill-type fork. Additionally, on October 11, 2007, November 5, 2007 and November 9, 2007, ROBERTS knowingly and unlawfully sold the narcotic drug cocaine. Arraignment for ROBERTS and GREENE is scheduled for next week.
