Office of the District Attorney P. David Soares Defendant Indicted For Attempted Murder in Domestic Disturbance ALBANY, NY – Albany County District Attorney P. David Soares announced today the indictment of PETER CAPONE, 40, of Cohoes, NY on (1) count of Attempted Murder in the Second Degree and (1) count of Assault in the First Degree. The indictment alleges that on or about July 25, 2007, CAPONE did attempt to commit the crime of Murder in the Second Degree when, with intent to cause the death of his girlfriend, the defendant did repeatedly strike the victim about the head and body with an unknown hard object. CAPONE caused serious physical injury to the victim consisting of a fractured skull and fractures to her arms. DA Soares noted that, “This is one of the most disturbing and severe cases of domestic violence this office has seen in a very long time.” Special Victims and Homicide Bureau Chief Dave Rossi is handling the prosecution of the case.
