Office of the District Attorney P. David Soares Domestic Disturbance Defendant Arraigned for Attempted Murder ALBANY, NY – Albany County District Attorney P. David Soares announced today the arraignment of PETER CAPONE, 40, of Cohoes, NY on (1) count of Attempted Murder in the Second Degree and (1) count of Assault in the First Degree before the Honorable Stephen Herrick. It is alleged that on or about July 25, 2007, CAPONE did attempt to commit the crime of Murder in the Second Degree when, with intent to cause the death of his girlfriend, the defendant did repeatedly strike the victim about the head and body with an unknown hard object. CAPONE caused serious physical injury to the victim consisting of a fractured skull, fractures to her arms, as well as other bruising and damage. DA Soares noted that, “The life-threatening injuries this woman sustained make this case one of the most severe and disturbing this office has seen in a very long time.
