Guilty Verdict in Teen Rape Trial

ALBANY , NY –  Albany County District Attorney P. David Soares announced today that MARCUS BROWN, 23, of Albany, NY, was found guilty of (1) count of Rape in the First Degree, a Class B Felony, and (2) counts of Rape in the Third Degree, a Class E Felony, in front of the Honorable Thomas A. Breslin. BROWN faces a maximum sentence of 25 years in prison with 5 years post release supervision for Rape in the First Degree and 2-4 years in prison for each count of Rape in the Third Degree.

On or about December 31 st, 2006, between 3:30 p.m. and 4:00 p.m., BROWN engaged in sexual intercourse with a female victim who was under the age of 13 at the time the incident took place. Additionally, in January and April 2006, BROWN, who at the time was 21 years or older, engaged in sexual intercourse with a female victim who was under the age of 17 at the time of said incidents occurring

“This is an instance where no length of time is sufficient enough to punish this offender,” commented DA Soares. “This guilty verdict on all counts will ensure this dangerous man is off our streets for a long time and it is my hope that today brings some closure to the victims and their families.”

Sentencing for BROWN is scheduled for September 26, 2007.
